TERMS & CONDITIONS

By booking any of our event spaces you agree to all terms and conditions below. Please read carefully to be sure to understand before sending your deposit.

Outside renters or vendors may be referred to as Client. Client understands and agrees that HUSH Events is not responsible for poor services rendered by any vendor. It will be the Client’s responsibility to settle all grievances and discrepancies with the vendor. HUSH Events will not refund any fees in the instance that a vendor is not satisfying to any client.   


In addition to the cost of the selected Services, HUSH Events recommends, but does not require that guests tip the servers, DJ and bartender. This service tax is suggested at 20% percentage of the event budget and depends upon the specific services booked. Cash, Zelle  and CashApp are accepted by most vendors and service providers.

(b) Credit card and debit payments require proof of identification. A valid driver's license belonging to the card holder and a photo of the credit card must be provided. A 8.25% fee for taxes and 4% processing fee will also be added to your total. 

​

(c) Upon signature, HUSH Events reserves the time and date agreed upon, and will not make other reservations for that specific time and date. For this reason, the deposit of 50% of the balance stated is NON-REFUNDABLE, even if the event date is changed or event canceled for ANY reason. 

​

The deposit is applied towards the total balance upon completion and submission of this Contract. The 50% deposit reserves the date and covers the substantial cost of materials purchased for the event. The Client understands and agrees that the entire amount owed is due 2 weeks PRIOR to the event.

LATE FEES

​

If a payment due by the Client is not made within the requirements mentioned in this Agreement, there will be a late fee that the Client will be charged. The fee is equal to $25 for each day payment is late plus applicable taxes and fees. 

​

If the Rental Fee plus late fees are not paid in full at least ten (10) business days prior to the Event, HUSH reserves the right to cancel the event without refund.

​

ACCESS TO VENUE


ALL visits shall be pre-scheduled with staff. Due to additional uses of the space, the CLIENT and/or its guests, vendors, etc are not to visit the property unannounced. Access to the venue prior to the scheduled event is limited. 

 

This access includes visits from any vendors being hired for the event. A $35+ fee may be accessed for excessive requests for visits/consultations. Delivery/vendor setup for the event outside of the agreed-upon time is not permitted without additional payment, prices may vary.

REMOVAL OF BELONGINGS

Client shall remove all personal property, trash, and other items that were not present in the venue when the Client took control of it. We will not be liable for any belongings left behind. Forgotten belongings may be retrieved when staff is on property or a $35 fee may apply to schedule an appointment.
 

EVENT STAFF

All events with 30+ guests in attendance, plus events with vendors such as live music, outside catering/bartender, food trucks, etc, are required to have one of our Event Staff members on hand at a rate of $35 per hour, charged to the CLIENT. 

 

Staff will assist before, during, and after your scheduled event has ended. They are not responsible for the full setup and arrangement of your event. They are only a helping hand there to assure your event goes smoothly, allowing you to enjoy yourself along with your guests. Duties may include:

*   Provide assistance and answer questions for guests
*   Assist with setup, tables, chairs, misc. (excluding additional decor set up)
*   Put out parking signs and direct guests as they arrive
*   Provide light cleaning (no trash duty)
*   Keep restrooms stocked and cleaned 
*   Duties must be discussed prior to the event and agreed upon in writing.

OVERTIME

– Venue Charge Overtime: of a fee equal to $250 per hour shall be charged to the Client  for their excessive use without notice.

– DJ Charge Overtime: a fee equal to $175 per hour shall be charged to the Client for their excessive use without notice

– Bartender Charge Overtime: a fee equal to $150 per hour shall be charged to the Client for their excessive use without notice.

– Open bar Charge Overtime: a fee equal to $20 per person per hour shall be charged to the Client for their excessive use without notice.

CLEANING

​

HUSH does not include cleanup in all of our rentals. Client or Approved Caterer is responsible for returning facilities to clean condition. Any excess cleaning will be billed to Client and due immediately. 


Cleaning expectations include:

- removing all of your belongings, food, beverages, boxes, trash and personal decorations

- Sweeping/mopping all large spills, and taking out all trash to the dumpster
 

Cleaning service may be added for an additional fee.

​

The Client is NOT to use any glitter, CONFETTI, silly string, or rice. Staple guns, duct tape, masking tape, packing tape or any item that would cause damage to the walls. windows or paint are not permitted. Painter's tape is acceptable. Feather Boas are also not permitted (or clothing with excessive feathers that shed). If any of the above is not followed, a $250 fee will be charged.

Event trash on the grounds, sidewalks, roadways and lawns (including cigarette butts) must also be cleaned up and placed in designated disposal containers.


HUSH is not responsible for checking in, checking out or signing for delivery or pick up of any items brought into or removed from the premises by rental companies hired by Renter. All packing materials and excess materials (such as bubble wrap, boxes, hangers, wrapping paper, etc.) created by deliveries must be removed and disposed by Client. HUSH’s trash receptacles are not to be used for vendor delivery debris. Extra charges may apply if the foregoing terms are not followed.

If the Client needs to store any items in the venue the night before or after, an additional fee of $100 per day will be charged.

​

ALCOHOL

 

Any and all liabilities arising from the consumption of alcoholic beverages or illegal narcotics on the premises are the responsibility of the Client.

​

Beer, wine, and mixed drinks MUST be served by one of our LICENSED AND INSURED bartenders.  Alcohol service must cease 45 MINUTES before the Client's exit time begins.

 

Specific behavior that will not be tolerated can include, but are not limited to, the following:


*Fighting
*Destruction of property
*Disrespectful conduct (to other Guests, Vendors or staff)
*Allowing minor persons to consume alcohol
*Possession and/or consumption of a personal supply of alcohol - this includes private vehicles located in the Event Center parking areas.
*Consumption of alcohol not served by bartender

 

At HUSH's sole discretion, we reserve the rights to:


*Evict any person(s) engaging in unacceptable activities outlined above, or not complying with the decision of staff.
*Close the bar and remove all alcoholic beverages from property & Withhold Client's Security Deposit.

*Termination of the event with no refunds to the Client & Withhold Client's Security Deposit if damage is done to the property.

 

SECURITY 
 

HUSH shall not be held liable for damage to or loss of any articles or property left on HUSH's property prior to, during, or after the event. Client shall be responsible for any damage done to HUSH's property by Client , its guests, invitees, employees or other agents under the Client's control or direction. HUSH is not responsible for security. All security costs are the responsibility of the Client. Security can be provided at an additional cost.

Client agrees that HUSH staff or their agents may enter and exit the premises during the course of the event. A representative of HUSH or designated staff member from an Approved Caterer may occasionally be on site during your event and will be checking as needed with the responsible parties.


Illegal use of drugs, illegal substances, weapons, guns, knives or fighting or threats made to the staff or any quest by the Client or any of the Client's guests on the premises is strictly prohibited and will result in termination of the Client's event.

 

HUSH reserves the right to ask any guest to leave if they are behaving rudely to any other guest or staff member. Client will be liable for any injuries or death resulting from the use of drugs, illegal substances, alcohol, fighting, guns, weapons, knives by the Client or any of the Client's guests during the Client's event.

 

HUSH shall fully cooperate with law enforcement agencies and prosecute perpetrators of this provision to the fullest extent of the law.

​

Client will be liable for any physical damages, missing property, legal actions, and/or loss of reputation or business opportunities that Owner may incur as a consequence of the actions of Client or any of Client's guests while Client is in control of the venue, and shall indemnify and hold harmless the Owner against any and all legal actions which may arise from Renter's use of the venue. It is the Client's responsibility to reimburse the owner for any damages that occur during the Client's rental period that were caused by the Client or the Client's guests. An invoice of the damages can be presented to the Client if requested.

AS IS

Client understands that the property, facilities, equipment, furnishings, and any other stated or implied physical articles are provided in "as is" condition and that no guarantee of a specific condition is provided by HUSH.

 

DAMAGES

If, during the course of your event, accidental damage does occur it should be reported immediately to HUSH staff or designated caterer staff so arrangements can be made for quick cleanup and restitution. Damage to any room, space, furnishings, and/or equipment by the Client or its guests or vendors will result in appropriate charges based on fair market cost of replacement, repair, additional cleaning, etc. If there is a cost associated with a damage incident, the price will be deducted from the Client's damages deposit prior to refund with written disclosure of pricing.

CANCELLATION

(a) This agreement cannot be canceled except by mutual written consent of both the Client and HUSH Events. If cancellation is initiated by the Client in writing and agreed to by HUSH in writing, Client will pay agreed upon tax compensation, forfeit their 50% deposit and be required to pay any unrecoverable costs already incurred. Events canceled with less than 14 days notice will forfeit the full amount paid.
 
(b) In addition to our general cancellation policy, specific Suppliers and vendors may also have additional cancellation policies beyond those of HUSH Events. For example, many venues do not permit changes to or cancellations of reservations after they are made. You agree to review the cancellation policies applicable to your Package prior to signing this contract and agree to pay any cancellation or change fees that you incur, and agree to indemnify, defend and hold harmless HUSH Events from any such fees.

(c) If circumstances (including but not limited to unreasonable last-minute requests or lacking staff members) arise and HUSH Events must cancel, all reasonable efforts will be made by HUSH Events to find comparable replacement event planning at the agreed upon fees. In the event that HUSH Events is unable to procure a replacement, Client shall receive a full refund of all fees paid. Client agrees that in all such circumstances, HUSH Events liability shall be exclusively limited to refunding the fees paid and that HUSH Events shall not be liable for indirect or consequential damages arising from any breach of this contract.

 

FORCE MAJEURE
(a) Due to unforeseen circumstances or causes beyond the our reasonable control, including, without limitation, acts of God, war, riot, embargoes, acts of civil or military authorities, acts of terrorism or sabotage, electronic viruses, worms or corrupting microcode, fire, flood, earthquake, accident, strikes, radiation, inability to secure transportation, extreme weather, failure of HVAC due to extreme weather, failures of communications or electrical lines, facilities, fuel, energy, labor or materials.

 

In an event of force majeure, your venue rental may be canceled or rescheduled to a future Sunday-Friday date for a period equal to the duration of the delay caused thereby. Any losses from cancellations with 3rd party vendors may not be transferable and must be addressed directly with the 3rd party vendor. The event venue is not liable for any losses or damages.

 

The Party subject to the force majeure shall (A) give notice of suspension of its obligations as soon as reasonably practicable stating the date and extent of such suspension and the cause thereof, (B) use its best efforts to remedy or remove such force majeure with the least practicable delay, and (C) resume the performance of its obligations as soon as reasonably practicable after the remediation or removal of the cause.

 

Notwithstanding anything to the contrary herein, if an event of force majeure can reasonably be expected to prevent the affected Party from performing its obligations for a period of twelve (12)months, then the other Party may terminate this Agreement upon not less than fifteen days written notice to the affected Party.

(b) Client agrees to take all necessary precautions to prevent injury to any persons or damage to property during the term of this Agreement, and shall indemnify, defend and hold harmless HUSH, its employees, representatives and/or agents from any claim, liability, loss, cost, damage, judgment, settlement or expense (including attorney’s fees) resulting from or arising in any way out of injury (including death) to any person or damage to property arising in any way out of any act, error, omission or negligence on the part of Freelancer or any Freelancer Employee in the performance or failure to fulfill any Services or obligations under this Agreement (except for gross negligence on the part of HUSH Events) This section shall survive the termination of this Agreement.
